Please read these Terms of Use carefully before using the Say & Read app.
These Terms of Use ("Terms") govern access to and use of the Say & Read: Kids Learn to Read mobile application (the "App") provided by Lion, LLC ("Lion," "we," "us," or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. About the App
Say & Read is an early-literacy app for young children, used together with a parent or guardian. A child speaks into the device, the App turns the child's words into on-screen text, and the child practices reading them. Tapping a word or letter speaks it aloud. All speech recognition and speech synthesis happen entirely on the device; the child's voice and words are never transmitted off the device. The App requires no account and works without an internet connection.
2. Parents and Eligibility
The App is designed for use by children together with a parent or legal guardian. These Terms are an agreement between Lion and you, the adult who downloads or sets up the App. You must be at least 18 years old to accept these Terms. By allowing a child to use the App, you accept these Terms on the child's behalf and agree to supervise the child's use.
3. License
Lion grants you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes strictly in accordance with these Terms.
4. Children's Use and On-Device Processing
The App is built so that no personal information about you or your child is collected by Lion:
- Speech is recorded and processed on the device only, using a speech-recognition model bundled inside the App, and is never sent to Lion or to any third party
- The optional child's name and the App's settings are stored only on your device
- The App contains no accounts, no advertising, no analytics, and no social features

5. Educational Disclaimer
The App is an educational practice tool. It is intended to support, not replace, reading instruction from parents, caregivers, and teachers. Lion makes no promises about educational outcomes, and the App's automated transcription and speech may occasionally mishear a word, display an imperfect transcription, or mispronounce a word. The App is not a diagnostic tool and does not assess, diagnose, or treat any learning condition.
6. Purchases
The App is currently free and contains no in-app purchases. If optional purchases are introduced in a future version (for example, a one-time unlock of additional content), they will be processed by Apple through your App Store account, placed behind a parental gate, described clearly at the point of purchase, and subject to Apple's payment and refund policies. Apple's standard Licensed Application End User License Agreement, available at apple.com/legal/internet-services/itunes/dev/stdeula/, also applies to your use of the App to the extent it does not conflict with these Terms.
7. Intellectual Property
All content, features, and intellectual property related to the App, including its original story retellings and design, are owned by Lion, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. Traditional rhymes and folk tales presented in the App are drawn from the public domain; Lion's adaptations and retellings are Lion's own. You may not copy, modify, distribute, sell, or lease any part of the App without prior written consent.
8. User Conduct
You agree to use the App only for its intended purpose as a children's literacy tool and not for any unlawful or unauthorized purpose.
9. Third-Party Services and Links
The App itself does not link children to external websites or services. Any links to Lion's own web pages (such as this document) are intended for parents. Your use of Apple's App Store is governed by Apple's terms.
10. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. Lion expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
11. Limitation of Liability
To the fullest extent permitted by law, Lion, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
In no event shall Lion's total liability exceed one hundred dollars ($100 USD).
12. Indemnification
You agree to indemnify, defend, and hold harmless Lion, LLC and its officers, members, employees, and agents from any claims, damages, losses, liabilities, or expenses (including attorneys' fees) arising from your use of the App or violation of these Terms.
13. Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
You may opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms.
14. Governing Law
These Terms shall be governed by the laws of the State of Illinois, without regard to its conflict-of-law principles. For disputes not subject to arbitration, you agree to the exclusive jurisdiction of the state or federal courts located within the State of Illinois.
15. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
16. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page. Continued use of the App after changes constitutes acceptance of the updated Terms.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Lion regarding the App.
